Fertility and Surrogacy Agreements (Egg Donor Agreement, Embryo Donor Agreement, Sperm Donor Agreement and Surrogacy Agreement)
A surrogacy agreement is a written agreement between a surrogate and one or more persons respecting a child to be carried by the surrogate, in which the surrogate agrees to not be a parent of the child, and each of the other parties to the agreement agrees to be a parent of the child. In Ontario, these pre-conception parentage agreements are required in order to clearly set out the intentions of the intended parents and the donor(s) or surrogate.
Domestic Contracts (Separation Agreement, Cohabitation Agreement and Marriage Contract)
A domestic contract is a written agreement negotiated between both spouses (common law or married) and their legal counsel (if applicable). Depending on the facts of your case and the type of agreement, a domestic contract will set out the terms and conditions relating to parenting, child support, spousal support and property division.
