What is Fertility Law?

In Ontario, fertility law is governed by the Assisted Human Reproduction Act. The law permits egg donation, sperm donation, embryo donation and surrogacy, however, it strictly prohibits the payment of surrogates or donors.

What is Surrogacy Law?

When a woman carries a child for intended parents, she is known as a surrogate. The intention is for the woman to give birth to the child and then to give the child to the intended parents once the child is born.

This is a complex area of law with serious penalties to anyone who contravenes the Assisted Human Reproduction Act such as fines and imprisonment. If you are considering involving a surrogate or wish to carry a child for intended parents, please contact me for an initial consultation.
